General Terms and Conditions of Use
Contract of Carriage
Preamble: This contract of carriage (hereinafter “Agreement”) constitutes the legal and binding contract between LaPuma GoGreen LLC dba GoGreenRide (hereinafter “GGR”), a licensed for-hire vehicle base with an eco-friendly fleet of vehicles, and the purchaser/recipient of services (hereinafter “You”). Your use of this web-based booking system and/or our mobile booking applications implies your consent and acceptance of all terms herein.
Pricing: GoGreenRide calculates your fare at the time of booking based on pick-up and drop-off location. This fare is displayed via our interface for your acceptance and constitutes the base fare from point A to point B. Once you accept the ride, this base fare will not change and will be used to calculate the final fare. The final fare charge will be the sum of the base fare quoted, plus any waiting time, tolls, or charges for additional stops, clean-up, gratuity and state mandated charges. You are responsible for payment of all charges incurred during the Trip.
Pricing Formula: Base Fare + Waiting Time (if applicable) + Tolls (if applicable) + Clean-Up or Damage fees (if applicable) + Tips
Waiting Time: Waiting time is charged at $45.00 per hour ($0.75 per minute) and accrues in one (1) minute increments. As a courtesy, we will extend a five (5) minute waiting period at your pick up on all trips prior to starting the waiting time counter.
Tolls: Our drivers are provided with routes that are the safest and least traffic affected to your destination. For some destination, this may result in taking a toll route. You are responsible for any toll charges incurred during a trip. Round trip tolls will be charged on trips where the driver cannot return to Manhattan without paying a toll. The driver will inform you of all tolls upon the completion of the trip and they will be added to bill.
Tips: These are completely based on your discretion.
Clean-Up Fee: You will be subject to a $20 clean-up charge should your actions while riding result in an excessively dirty condition that requires extra cleaning or deodorizing. This includes, but is not limited to, spillage of fluids, food, vomit, other stains, and unpleasant odors.
Damage Fee: Should you purposely cause any damage to the vehicle’s exterior, interior or in-vehicle electronics, GGR shall charge for damage to or repair of the vehicle and any enforcement charges relating to such damage or repairs (including legal costs).
Per Hour Requests: Our drivers are available for by-the-hour bookings at an hourly pricing of $45.00 per hour, with a minimum of 2 hours. Trips are limited to the five boroughs of New York City only (Bronx, Brooklyn, Manhattan, Queens, Staten Island) and the time period charged will end when the car is back in Manhattan, with or without you. In case the time you used the car (driving or waiting) is less than the booked duration, you will be charged for the initially booked duration. Extension of your book-by-hour period is subject to availability. Should you wish to extend your book-by-hour period, you will be charged for the actual used period.
Cancellations and No-Show Fees:
Cancellation Time Frames:
For “Ride Later” and “Book per Hour” pick-ups within the city: Cancellation is possible anytime but the reservation must be cancelled at least 45 minutes before the requested pick up time to avoid the cancellation fee.
For “Ride Now” pick-ups: Our “Ride Now” option results in an automatic dispatch by our system of the nearest car to you, so there isn’t a cancellation grace period after you have submitted the pick-up request. Should you cancel, after a vehicle has been dispatched, we will charge a $10 cancellation fee.
For Airport Pick-ups: Reservation must be cancelled at least 60 minutes before the requested pick up time to avoid a cancellation fee.
For Out-of-Town Pick-ups and other special requests: Reservation must be cancelled at least three (3) hours before the requested pick up time to avoid a cancellation fee.
Cancellation and No-Show Fees:
No-shows and orders not cancelled in time, will be charged the following base rates:
For Manhattan Pick-ups: $10.00 or Waiting Time, whichever is greater.
For Outer Borough Pick-ups: Cost of trip from waiting location to 17 State Street, NY, NY 10004
For Airport Pick-ups: Cost of returning to 17 State Street, NY, NY 10004
For Out of Town Pick-ups: Cost of returning to 17 State Street, NY, NY 10004
Payment: In order to book rides, you must have a registered account with GGR and an active, valid credit or debit card on file. Payments for reservations made via gogreenride.com or via the GoGreenRide mobile application will be charged to the credit or debit card on file. You agree that GGR can charge Your credit or debit card for payment of all amounts payable under this Agreement. With respect to such charges the following authorization applies: You authorize automatic and on demand Card Payments by GGR. You agree that the charges quoted to you at the time of booking plus all additional charges per the formula in Section 2 will be billed to the credit or debit card provided by You. A detailed receipt for all payments via your credit or debit card will be emailed to You.
You must provide current, complete, and accurate information for Your billing account, and promptly update any changes (such as a change in billing address, credit card number, credit card expiration date, bank account number) and contact email address by updating your GGR profile information.
If GGR is unable to process Your credit or debit card at any time, Your account may be immediately suspended and You will remain responsible for all amounts payable by You to GGR and You will be liable for any collection costs. Your card issuer agreement governs use of Your credit or debit card payment in connection with this Service and you must refer to that agreement with respect to Your rights and liabilities as a cardholder. If GGR does not receive payment from Your credit or debit card issuer or its agent, You agree to pay GGR all amounts due upon demand by GGR. You agree that GGR will not be responsible for any expenses that You may incur resulting from overdrawing Your bank account or exceeding Your credit limit as a result of any charges made under this Agreement.
Online Account Management: GGR makes an online account management tool available to You for managing your profile, payment information, favorite destinations, and to view your trip history.
Loss and Damage: While our drivers try their best to proactively look out for any left behind items in between pickups, we are not responsible for any property that is left behind or damaged in one of our vehicles. If you think that you may have left something behind, please contact us as soon as possible via email@example.com or via our main phone number. We understand that every lost item is very important to each individual, and undergo an exhaustive search to locate every single item reported. Please be assured that we take each Lost Item Report very seriously and will go to every effort to locate and return your lost item(s). Should an item be found, GGR will retain it for thirty (30) days. Once the item has been located, you will be sent an email notification with a pick-up address to arrange for its retrieval.
Force Majeure: Service is provided on a best effort basis. While we try our best to navigate for timely pickups and drop-offs, we are not responsible for delays, service interruptions or damages caused by acts of God, strikes, riots, authorities of law, public enemies, hazards or dangers caused by a state of war, quarantine, perils of navigation, inclement weather, hazardous road conditions, accidents or breakdowns or any other condition beyond our reasonable control. Further, GGR’s service and application may be subject to limitations, delays and other problems inherent in the use of the Internet and dependent on electronic communications. GGR is not responsible for any delays, delivery failures, or other damage resulting from such problems.
The Services are provided on an “as-is, where-is” basis without any warranty of any kind, whether express or implied, including (without limitation) ANY IMPLIED WARRANTIES ARISING FROM STATUTE, COURSE OF DEALING, COURSE OF PERFORMANCE OR USAGE OF TRADE.
Smoking: Smoking is strictly prohibited inside of our vehicles.
Service Refusal: We reserve the right to refuse service to anyone who appears to be intoxicated, under the influence of drugs or displays erratic behavior which makes our drivers fear for their safety.
Indemnification: By entering into this Agreement and using the Application or Service, you agree that you shall defend, indemnify and hold GGR, its licensors and each such party's parent organizations, subsidiaries, affiliates, officers, directors, Users, employees, attorneys and agents harmless from and against any and all claims, costs, damages, losses, liabilities and expenses (including attorneys' fees and costs) arising out of or in connection with: (a) your violation or breach of any term of this Agreement or any applicable law or regulation, whether or not referenced herein; (b) your violation of any rights of any third party, including providers of transportation services arranged via the Service or Application, or (c) your use or misuse of the Application or Service.
Legal Statement: By using the Application, Service and/or site, you expressly represent and warrant that you are legally entitled to enter this Agreement and you specifically accept and agree to abide by all terms and conditions herein. You should not use this Site if you do not accept and agree. This Site is available only for your personal use, which is limited to viewing the Site, providing information to us, downloading information for your personal use and for scheduling service. Visitors assume all responsibility and risk with regard to using this Site and, in no case, shall GoGreenRide be liable for damages of any kind resulting from customer use of the Site.
Information on Site: Every effort is made to provide accurate and up-to-date information on this Site. GGR is not responsible for typographical errors and does reserve the right to make corrections and changes to the Site at any time without notice. The prices displayed are in U.S. dollars.
Copyright: All content included on this site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of GGR and protected by United States and international copyright laws. The compilation of all content on this site is the exclusive property of this site's owner and protected by U.S. and international copyright laws. All software used on this site is the property of this site's owner or its software suppliers and protected by United States and international copyright laws.

THE COMPANY DOES NOT REPRESENT OR WARRANT THAT (A) THE USE OF THE SERVICE OR APPLICATION WILL BE SECURE, TIMELY, UNINTERRUPTED OR ERROR-FREE OR OPERATE IN COMBINATION WITH ANY OTHER HARDWARE, APPLICATION, SYSTEM OR DATA, (B) THE SERVICE OR APPLICATION WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS, (C) ANY STORED DATA WILL BE ACCURATE OR RELIABLE, (D) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS, OR (E) ERRORS OR DEFECTS IN THE SERVICE OR APPLICATION WILL BE CORRECTED. Dispute Resolution: The validity, construction, and enforcement of this Agreement, and the determination of the rights and duties of the parties, will be governed by the laws of the State of New York without regard to any provisions of its choice of law rules that would result in a different outcome. The parties consent to the jurisdiction of the courts serving New York County, New York, for all disputes arising out of this Agreement.
Severability: A holding by a court of competent jurisdiction that one or more of the provisions contained in this Agreement is unenforceable in any respect will have no effect on the validity of any of the remaining provisions of this Agreement.
Claim Limit: No action arising out of the performance of Service by GGR under this Agreement may be brought by You more than six (6) months after such cause of action arose.
Refunds: If there was an issue with your ride or if you would like your cancellation fee for a trip reviewed, please tell us what happened by writing to firstname.lastname@example.org or contacting our customer service at (212) 364-2000.

In order to become a member, a user must first complete the registration form. During registration a user is required to give certain information (such as name and email address). By using gogreenride.com, you grant us access to your information and site activity data. We request information from you on our reservation form to quote and book rides via our service. LaPuma GoGreen LLC dba GoGreenRide understands that parents often purchase our services for family use, including for use by minors. GoGreenRide’s website is for use by individuals 13 years of age or older. We will not knowingly collect Personal Information from children under the age of 13. Individuals under 13 years of age are not permitted to use our website or even submit their Personal Information at our Website.
